Delivery times are estimates only and are not guaranteed. We are not liable for shipping delays caused by carriers, weather, customs, supply disruptions, or events beyond our control.

Unless otherwise required by applicable law, title and risk of loss pass to you when the product is transferred to the carrier.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

19. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAWG HOLSTERS, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, LICENSORS, OR PARTNERS, OR SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO THE SERVICES, THESE TERMS, OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR AGGREGATE LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES, THESE TERMS, OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES WILL NOT EXCEED THE GREATER OF:
(a) ONE U.S. DOLLAR (US $1.00), OR
(b) THE TOTAL AMOUNT PAID BY YOU TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM DURING THE ONE-MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

20. Indemnification

You agree to indemnify, defend, and hold harmless HAWG Holsters, Shopify, and our affiliates, officers, directors, employees, agents, contractors, licensors, service providers, and partners from and against any claims, liabilities, damages, judgments, losses, costs, expenses, or fees, including reasonable attorneys’ fees, arising out of or relating to:

  • your violation of law or the rights of a third party; or

Any action or proceeding arising out of or relating to these Terms shall be brought in the state or federal courts located in Arizona, and you consent to the jurisdiction of those courts.

25. Waiver of Jury Trial

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND HAWG HOLSTERS EACH WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION, PROCEEDING, OR COUNTERCLAIM ARISING OUT OF OR RELATING TO THE SERVICES, THESE TERMS, OR ANY PURCHASE OR TRANSACTION BETWEEN YOU AND US.

26. International Sales Convention

The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms or to any purchase, sale, or transaction made through the Services.

PART III — FIREARM WARNINGS AND SAFETY INFORMATION

1. Firearm Training

Before using any HAWG Holsters product, you should obtain appropriate training in the safe handling, carrying, drawing, holstering, and operation of firearms. Safe firearm handling is your responsibility.

2. Firearm Warning

Always test any holster for proper fit using an unloaded firearm before use. Always keep your fingers away from the trigger when holstering, carrying, or drawing a firearm. Accidental discharge can cause serious injury, death, or property damage.

Each time you use a holster, ensure that the firearm is fully seated in the holster and that clothing, straps, cords, and body parts are clear of the holster opening and trigger area. If a holster includes retention devices or straps, ensure they are functional and used properly. Never remove, disable, or alter a factory-supplied retention feature unless expressly authorized in writing by the manufacturer.

No holster can guarantee complete retention of a firearm in every circumstance or prevent access by a determined assailant. Regular training and practice are essential to safe and effective use. You are solely responsible for the safe handling, carry, storage, and use of any firearm and any accessory used with our products.

3. Security Personnel and Law Enforcement Purchases

Where a security company, law enforcement agency, or other organization selects or purchases a holster or related product for an employee, officer, contractor, or other end user, that organization is responsible for evaluating whether the product is appropriate for the intended firearm, use case, retention level, training environment, and duty requirements.

The purchasing organization is also responsible for providing appropriate firearms safety and retention training to the end user. No holster can guarantee prevention of firearm takeaway or unauthorized access in all circumstances. Training, supervision, and policy compliance remain the responsibility of the purchasing organization and the end user.
